Terms of Service

These Terms of Service ("Terms") govern your use of the FromPast mobile application and the message pages and related services that FromPast provides (together, the "Service"). The Service is provided by Nicher ("Nicher," "we," "us," or "our"), located at 807-45, 385, Gangseo-ro, Gangseo-gu, Seoul 07803, South Korea.
By using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we process personal data and is available from the Service.
Eligibility and Guardian Permission
You must be at least 13 years old to use the Service. If you are below the age of legal adulthood where you live, your parent or legal guardian must review these Terms with you and give you permission to use the Service.
A law may require a higher minimum age, parental authorization, or another safeguard for a particular feature or processing activity. In that case, you may use the affected feature only when the requirement is satisfied. These requirements concern the applicable activity and do not change our general 13-year minimum into a country-specific contract age.
The Service
FromPast lets you create a message, choose a future delivery time, optionally attach media, and make the message available to its intended recipient through a private message link. Current Send-to-Other messages are delivered by email. We may continue to deliver SMS messages that were validly scheduled while SMS delivery was previously available, but users cannot create new SMS deliveries in the current app.
The Service may also send you push notifications about message delivery or reading status. Delivery depends on networks, recipient systems, device settings, and third-party services that we do not fully control. We do not guarantee that a message, notification, or link will arrive at an exact time or remain available indefinitely.
Recipient Information and Permission
When you provide a recipient's email address or select it from your device Contacts, you represent that you are authorized to use it for the message. You must not use the Service for unsolicited bulk messaging, harassment, deception, or any unlawful communication.
We use recipient information to schedule and deliver the message, provide the message link, prevent abuse, and honor recipient blocks or reports as described in the Privacy Policy. A recipient may ask us to block future messages associated with the relevant sender or contact information.
Your Content
"Content" means the text, images, videos, names, titles, and other material you submit. You retain your rights in your Content and are responsible for it, including having all permissions needed to submit and send it.
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, copy, format, transcode, transmit, and display your Content only as needed to operate, secure, and improve the Service, deliver it to the intended recipient, comply with law, and resolve reports. This license ends when the Content is deleted from our active systems, except to the extent a limited copy must remain for backups, security, dispute resolution, or legal compliance.
Keep your own copy of important Content. Although we use operational safeguards, we do not promise permanent storage, backup, or restoration of Content.
Acceptable Use
You must not use the Service to create, upload, send, or promote:
- illegal, fraudulent, threatening, harassing, defamatory, hateful, discriminatory, or sexually exploitative material;
- content that infringes privacy, publicity, intellectual-property, or other rights;
- malware, harmful code, automated spam, chain messages, or unsolicited advertising;
- false identity claims, impersonation, or misleading information intended to cause harm; or
- activity that interferes with, probes, circumvents, or abuses the Service or its security controls.
We may investigate reports and remove Content, block delivery, restrict access, preserve relevant evidence, or cooperate with lawful requests. These actions do not transfer your responsibility for your conduct to us.
Advertising and Rewards
The current Service is supported by advertising, including banner, interstitial, and rewarded ads. Some features may let you choose to watch a rewarded ad to send a message or receive a ticket. A reward is granted only when the applicable completion event is received, except where the app expressly allows the action to continue because an ad is unavailable. Tickets are limited Service credits, have no cash value, and cannot be transferred or redeemed for money.
Ad availability, content, and personalization depend on your region, consent choices, device settings, and the advertising provider. The Privacy Policy explains advertising data and controls.
Legacy In-App Purchases
The current app does not offer new in-app purchases. It may still observe and verify an outstanding Apple App Store or Google Play transaction created under an older version so that a previously purchased ticket entitlement can be granted and the store transaction can be completed.
Apple or Google processes the payment and controls store refund procedures. Refund rights and decisions are governed by the applicable store rules and mandatory law. Contact the relevant store for a refund request, and contact us if you need help identifying a FromPast transaction.
Intellectual Property and Feedback
The Service, excluding your Content, and its software, design, branding, and other materials are owned by Nicher or its licensors and are protected by applicable law. These Terms do not grant you a right to use our trademarks or copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as applicable law permits.
If you voluntarily provide suggestions or feedback, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use and incorporate it without restriction or compensation.
Copyright Complaints
If you believe Content available through the Service infringes your copyright, email chris@nicher.io with your contact information, identification of the work and allegedly infringing material, its location, a good-faith statement that the use is unauthorized, a statement that your notice is accurate and that you are authorized to act, and your physical or electronic signature. We may remove or restrict the material while reviewing the notice.
Third-Party Services
The Service depends on third parties for hosting, storage, scheduling, email, legacy SMS, notifications, analytics, diagnostics, advertising, consent management, and legacy store transactions. Their services and links may be governed by their own terms and privacy policies. We are not responsible for third-party content or services outside our control.
Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate access, block a delivery, or remove Content when reasonably necessary to protect users or the Service, enforce these Terms, respond to a report, or comply with law. Provisions that by their nature should survive termination, including ownership, licenses already needed for retained records, disclaimers, liability limits, and dispute terms, will survive.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We do not promise uninterrupted or error-free operation, permanent availability, exact delivery timing, compatibility with every device or provider, or that all harmful activity will be detected. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, Nicher and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, revenue, data, goodwill, or business opportunity arising from the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid to Nicher for the Service during the 12 months before the event giving rise to the claim or USD 100.
These limits do not apply where prohibited by law or to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.
Governing Law and Disputes
These Terms are governed by the laws of South Korea, without regard to conflict-of-law rules. This choice does not deprive you of mandatory consumer protections available under the law of your habitual residence.
Before starting formal proceedings, please contact us and try to resolve the dispute informally. These Terms do not require an exclusive court or prevent either party from using a court, regulator, consumer-protection body, or dispute process available under applicable law.
Changes to the Service or These Terms
We may change the Service and these Terms. If a change materially affects your rights, we will provide reasonable advance notice in the Service or by another appropriate method when required. The updated Terms apply from the stated effective date. If you do not agree, stop using the Service.
Translation
Translations are provided for convenience. The English version controls if a translation conflicts with it, but only to the extent permitted by applicable law. Mandatory rights based on a legally required local-language disclosure are not limited by this clause.
